-- A man has been charged with felony driving under the influence after a 3-year-old boy died from injuries in a wreck in Richland County late last week. Charges against 44-year-old Lonnie Gross III were upgraded to felony DUI resulting in death Tuesday after Josiah Caden Jenkins of Columbia died at Palmetto Health Richland hospital. The boy was in a car driven by his mother Friday evening when his car was struck by another car. She was treated and released from the hospital. Gross also is charged with driving under suspension and failure to wear a seat belt. It was not clear if Gross has an attorney. A background check by the State Law Enforcement Division shows Gross had a DUI conviction in Lexington County in 1993, another in Kershaw County in 1999, one in Elgin in 2000 and another in Kershaw County in 2007. Gross was out of jail on bond awaiting trial in a November DUI arrest at the time of Friday's accident, SLED records show.

"Annie's Law" aims to help prevent drunk driving deaths

Under Senate File 2299, people convicted of their first offense of operating while intoxicated (OWI) would still face 48 hours of mandatory jail time, but the fine could be reduce by half from $1,250 to $625 and a six-month driving suspension would be altered to require that a driver using the interlock option would have to be lock-out free for the last three months. That would mean not recording a blood-alcohol content of .04 percent or above when blowing into the device for three consecutive times within 15 minutes. Sen. Chris Brase, D-Muscatine, said the goal of the bill is to encourage people to use the interlock ignition devices so they can keep working and take steps to improve their behavior behind the wheel that are impeded by a six-month license suspension. A provision of the measure would reduce the cost for the device for low-income OWI offenders. Sen. Michael Breitbach, R-Strawberry Point, one of three Republicans who voted for the bill, said he hoped the changes would not be viewed as weakening current law but rather helping to get people who made a mistake back on the right track and keep them going in the right direction. HOWEVER, AFTER Tuesdays floor debate, Senate GOP Leader Bill Dix of Shell Rock issued a statement saying Republicans voted to uphold significant driving restrictions for people convicted of OWI offenses. Senate File 2299 makes it easier for people convicted of operating while intoxicated to get back on the road, Dix said in a statement. Current law restricts where those found guilty of OWI can travel. Under Senate File 2299, with an ignition interlock device, someone sentenced to first offense OWI can drive wherever they like, he added. It is imperative that we continue to explore ways to keep our roadways and all Iowans safe, not explore new opportunities to ease the penalties and fines for people convicted of such serious criminal behaviors. Three GOP senators Breitbach, Nancy Boettger of Harlan and Brad Zaun of Urbandale voted with 25 Democrats to pass the bill and send it to the Iowa House for consideration, while Democrat Matt McCoy of Des Moines joined 19 GOP senators in opposing the law.

DES MOINES The Iowa Senate voted 28-20 Monday to modify state drunken driving laws to allow first-time offenders the option of using an interlock ignition device that would enable them to keep driving to work and other places as long as they stayed sober behind the wheel. Under Senate File 2299, people convicted of their first offense of operating while intoxicated (OWI) would still face 48 hours of mandatory jail time, but the fine could be reduce by half from $1,250 to $625 and a six-month driving suspension would be altered to require that a driver using the interlock option would have to be lock-out free for the last three months. That would mean not recording a blood-alcohol content of .04 percent or above when blowing into the device for three consecutive times within 15 minutes. Sen. Chris Brase, D-Muscatine, said the goal of the bill is to encourage people to use the interlock ignition devices so they can keep working and take steps to improve their behavior behind the wheel that are impeded by a six-month license suspension. A provision of the measure would reduce the cost for the device for low-income OWI offenders. Sen. Michael Breitbach, R-Strawberry Point, one of three Republicans who voted for the bill, said he hoped the changes would not be viewed as weakening current law but rather helping to get people who made a mistake back on the right track and keep them going in the right direction. However, after Tuesdays floor debate, Senate GOP Leader Bill Dix of Shell Rock issued a statement saying Republicans voted to uphold significant driving restrictions for people convicted of OWI offenses. Other courts have ruled that prosecutors arent obligated to provide defendants with blood or breath test samples for independent testing (even though both are feasible and relatively cheap to do). In almost every other facet of criminal law, defendants are given access to the evidence against them. These decisions havent gone unnoticed in state legislatures. Forty-one states now reserve the right to revoke drunken driving defendants licenses before theyre ever brought to trial.

"Jail is really only an effective tool if it is used as a threat to make the drunk driver comply with other orders for probation, treatment, community service, alcohol testing." Federal highway officials and National Institute on Alcohol Abuse and Alcoholism issued sentencing guidelines in 2006 that are used by drunken-driving courts nationwide. "The available evidence suggests that as a specific deterrent, jail terms are extremely costly and no more effective in reducing (drunken-driving) recidivism," the manual notes, adding that one study found "two days in jail may have a specific deterrent effect and may be more effective than a two-week sentence for first-time offenders." Instead, the manual suggests several sanctions, including the use of ignition interlock devices that require offenders to blow into a device that prevents the car from starting if the driver has been drinking. Mothers Against Drunk Driving ( MADD ) said those devices are the leading tool in stopping drunken driving. "There needs to be that threat of incarceration because drunk driving is a crime," said Frank Harris, the state legislative affairs manager for the national MADD office. "But we are finding the most effective way is to have the ignition interlock." Piquero said the jury is still out on the effectiveness of the devices because researchers haven't had the chance to study them yet. Advocates call for tougher DUI laws in Wyoming

31 /PRNewswire/ -- Los Angeles DUI lawyer Lawrence Taylor claims that the current DUI laws discriminate against women. Taylor, nationally-known author of the book Drunk Driving Defense, cites researchers at the University School of Medicine in Trieste, Italy, who found that women have less alcohol dehydrogenase than men. With less of the enzyme that breaks down alcohol in the stomach, women reach the same blood alcohol concentration as men after drinking only half as much. The scientists found that women reached blood alcohol levels illegal in a DUI case after drinking 20 to 30 percent less alcohol than men of equal weight. The scientists' conclusion was reported in 322(2) New England Journal of Medicine 95: legislatures need to consider sex differences in drafting DUI laws. Taylor, who heads a law firm of Los Angeles DUI lawyers and Orange County DUI lawyers, cites another study reporting lower partition ratios in women - the ratio of alcohol in the breath (measured by breathalyzers in DUI cases) to alcohol actually in the blood. The breathalyzer assumes a ratio of 2100:1, but that is only an average and varies from person to person. According to a study in the scientific journal Analytical Toxicology, women have significantly lower partition ratios than men. And the lower the ratio, the higher the reading -- even though the true blood alcohol level does not vary. A Santa Rosa man under surveillance as a habitual DUI driver with 19 arrests for driving under the influence on his record was taken into custody Friday afternoon for operating a vehicle with a suspended license, according to Petaluma Police. At approximately 2 p.m. Friday, Petaluma police officers working a special operation targeting repeat DUI offenders observed a suspect driving away from his home. Officers contacted the driver, 68-year-old Santa Rosa resident William Beall, who is a known repeat DUI offender with 19 DUI convictions in the past thirty years.Beall's driver's license is currently suspended, so he was taken into custody. Beall was booked into county jail for driving with a suspended drivers license. The Petaluma Police Department Traffic Unit maintains a list of all DUI drivers arrested and on probations of those residing in Sonoma County. Drivers with multiple convictions or with prior arrests with high blood alcohol levels are then evaluated for potential risk to the motoring public. Those drivers determined to be the highest risk to public safety are then targeted for surveillance under the Habitual DUI Driver Stakeout Program.

Authorities said the driver of the Chevy Camaro walked away unharmed. Two Latino men, believed to be in their 20s or 30s, were in the Acura Integra and had to be rescued by emergency responders. They had to get the Jaws of Life to pry the door open, said Desrochers. The passenger inside the Acura died at a hospital. Witnesses reportedly saw the driver of the Acura trying to walk away from the scene, but officers stopped him. He was arrested for allegedly driving drunk and faces a charge of gross vehicular manslaughter when he is released from the hospital. It is horrific that people still drink and drive like this in this day and age when there is so much prevention to stop doing that, said resident Kurt Tademy.

Fernandez has almost half of his arrests that don't result in someone being convicted of DUI. In this case, the State Attorney's Office found Fernandez and his unit were wrong again and there was insufficient evidence of Campbell's alcohol impairment.

The decision, of course, is up to the states. There has been resistance in some state legislatures to requiring interlock use by first-time offenders. Maryland mandates them for repeat offenders and those well over the .08 percent blood alcohol level, but has not moved to require them for first-time convictions. Now Strickland can dangle $20.8 million in highway safety funds as incentive for states to require the devices for everyone convicted of the crime. NHTSA released new data this month showing that almost one-third of highway fatalities 10,228 in 2010 resulted from crashes in which alcohol use was a factor. And 70 percent of those fatal accidents involved a driver whose blood alcohol level was nearly twice the legal limit or above. Theyre not just driving drunk. Theyre driving super-drunk, said Kurt G. Erickson, president of the Washington Regional Alcohol Program . In addition to repeat offenders and the thoroughly drunk, Erickson said interlock programs help with the core audience for drunken driving, males between the ages of 21 and 35. Its a group thats proven to be resistent to run-of-the-mill campaigns, he said. Youve got to hit them with a strong law enforcement message and show them that the odds are stacked against them if they make the mistake of drinking and driving. Montgomery County Police Chief J. Thomas Manger agreed. The harsher the penalty, the more the deterrent effect, said Manger, who said he favors interlocks for first-time convictions. The statistics show that over 40 percent of the people who are involved in drunk driving crashes are repeat offenders. He pointed out that almost a third of those who die in drunken-driving crashes are innocent victims, not the person who is drunk. He said there were 786 crashes in Montgomery County in 2010 in which alcohol played a role. The cost of installing an interlock and paying for a monitoring service that sends reports to the state falls to the convicted drunken driver. Those costs vary, but $75 for installation and about $70 per month for monitoring appear to be about average.

Drunk Driving Laws Are Out of Control

Government to do more in creating a meaningful review process, such as allowing for police officers to be cross-examined on their evidence, rather than simply submitting sworn documents. Now, dont get me wrong: lowering (or better yet, eliminating) drunk drivers on the road is an incredibly important and laudable goal. Drinking and driving is beyond stupid. But, Charter rights (and the related fair process) need to be respected as these Charter rights separate Canada from less desirable countries. These changes might be adequate and pass Charter scrutiny. Or they might not. Time will tell. Whatever happens, I hope that the B.C. Government (regardless of political affiliation) starts taking its time with drafting legislation.

MADD urges new legislation

The proposed bill replaces the requirement with the use of ignition interlocks which require convicted drunk drivers to prove sobriety when driving on Iowa roads which a time/geographic restricted license cannot accomplish. MADD representatives say the bill, if passed, would make Iowas OWI law one of the strongest and most effective ignition interlock laws in the nation as convicted drunk drivers must use the device before regaining unrestricted driving privileges. Fort Madison Police Chief Bruce Niggemeyer said as he understands it, the proposed bill will give the current law more teeth. This seems to me to be a zero-tolerance law, Niggemeyer said. The person who will be affected the most is the guy who goes out once a year and has a beer on his birthday. If hes caught, hell have an interlock on his ignition for six months. Niggemeyer said he is not saying this is a bad thing and always encourages people who plan to drink to do it at home. Lee County Sheriff Jim Sholl said although he favors the bill, he doesnt want it to take the place of the current law. It almost looks like MADD is pushing the interlock in lieu of time and geographical limitations, Sholl said. I dont necessarily agree with that. Sholl explained that the interlock method would keep people from starting their vehicles for a period of time, but it would do nothing to keep them out of their friends or familys cars. He said if this bill replaces the current law and removes license suspensions, it creates a loophole. Overall, Sholl said it is a good idea. I would think anything we can do to reduce the alcohol-related accidents leading to fatalities and injury makes good sense, Sholl said. As for excuses for driving after drinking, Sholl will have no part of them. I think society has accepted how dangerous it is for the motoring public to be faced with drunk drivers, Sholl said.

If so, the net result could be fewer traffic fatalities, even if there is an increase in the number of stoned drivers, because alcohol has a more dramatic effect on driving ability than marijuana does. A study published last year by theJournal of Law & Economicsfound that adoption of medical marijuana laws is associated with adeclinein traffic fatalities, possibly because of such a substitution effect. Data from the Washington State Patrol According to data from the Washington State Patrol, the number of drunk driving arrests by that agency fell from 17,382 in 2012 to 15,401 in 2013, an 11 percent drop. By comparison, the number of drunk driving arrests fell by 2 percent between 2009 and 2010, stayed about the same between 2010 and 2011, and fell by 6 percent between 2011 and 2012. Although the drop in drunk driving arrests after marijuana legalization looks unusually large, it should be interpreted with caution, since the number of arrests is partly a function of enforcement levels, which depend on funding and staffing. No one can focus on the road in front of them and never lapse in attention. 3. This statement will justify cell phone = talking children = DUI. Trust me, the government will not eliminate DUI, instead they will treat everyone else as harsh as DUIs. 4. The cell phone "studies" are skewed by people that want laws against cells in cars. B.C. Drunk-Driving Laws Challenge Dismissed By Appeal Court

They allow police to impose immediate roadside penalties, including fines and fees, driving bans and seizure of a vehicle. The court released the judgment after several people who received roadside prohibitions argued the law is unconstitutional. The BC Civil Liberties Association told the appeal court earlier that the laws violate the right to be presumed innocent until proven guilty. Attorney General Suzanne Anton has said the three-year-old law has saved almost 200 lives. The provincial government was forced to amend the laws two years ago when a B.C. B.C. appeal court dismisses drunk-driving laws challenge

By CLEVER ZULU - THE Lusaka fast-track court has sentenced a 26-year-old man to four months simple imprisonment after he failed to pay a fine of K2,000 for drunken driving. Lusaka magistrate Fides Hamaundu sent Mwavwe Sinyinza to prison after he failed to pay the K2,000 admission of guilt fine. Sinyniza had admitted to the charge of drunken driving. Particulars of the offence are that on March 3, in the central business district of Lusaka, Sinyinza was driving a motor vehicle under the influence of alcohol contrary to section 157 sub-section One of the Road Traffic Act number 11 of 2002 of the Laws of Zambia. Sinyinza was apprehended after his breath exceeded the permitted limit of 0.38 grammes of alcohol. In mitigation after failing to pay the fine, Sinyinza asked the court to exercise leniency as he had learnt his lessons not to drive under the influence of alcohol, and that he was remorseful of his actions. But in passing judgment, the magistrate observed that the cases of drunken driving were on the rise, and that there was need for drivers to stop driving under the influence of alcohol to reduce on road traffic accidents. Offences of drunken driving are prevalent in society nowadays. There is need to punish offenders and deter would-be offenders to reduce on road accidents, she said. Last week the court sent four people to prison for dangerous driving and drunk driving. They are all serving four months simple imprisonment.
